[Re-entry of a Foreigner Deported from Japan]


 
The landing of a foreigner who has been deported shall be refused for 5 years from the date of deportation (period of refusal of landing). However, the re-entry after such period will not always be permitted.

   1. Those whose re-entry shall be refused
almost permanently

     1) Violators of the law

         Any foreigner who has been convicted of a violation of any
        laws or regulations of Japan or any other countries and
        sentenced to the penal servitude or imprisonment for
1 year or
       
more (a suspended sentence included).

         However, when a foreigner fulfills the following conditions,
        the Minister of Justice may grant a special permission for
        landing at his discretion.

          - The period of suspended sentence was over.

          - The reason for refusing his landing is not so serious.

          - There are special circumstances such as a spouse of
            Japanese national, etc.

     2) Violators of the
drugs control law

     3) A person who was engaged in activities concerned to
         
prostitution.

   2. Those who have been deported by reason of illegal residence,
      engaging in activities other than permitted or violating laws
      other than those concerned to drugs or prostitution (
limited to
      the penal servitude or imprisonment for
less than 1 year).

     1) Those who have been arrested by a Regional Immigration
        Officer and deported without being punished.

         The re-entry after the period of refusal of landing will not
        always be permitted.

     2) Those who have been arrested by a policeman and punished
        with the penal servitude or imprisonment for less than 1 year.

         The re-entry after such period may be permitted.


[Revision of the Immigration Control Law] (As of 1st of March, 2002)

  The re-entry of a foreigner who has been released with a suspended sentence (penal servitude or imprisonment) and has not been deported because of leaving Japan before the sentence was finalized, shall also be refused for
5 years from the date when the sentence was finalized.
